SMS PRIVACY AND COMMUNICATION POLICY

 

Communications

By signing up to receive text messages (including SMS messages) from the City Bank (bank), when applicable, you expressly agree to receive recurring automated messages at the phone number provided.  Your mobile telephone provider may charge you according to the type of plan you carry. Your consent will be effective regardless of any registration with any state or federal Do Not Call list or other comparable list or registry. Your consent shall remain in effect until you revoke it.

Personal Information Collected

Through the use of the Service, the bank will receive the following information from our service provider: (1) your mobile phone number when you send a text message (SMS messages) to us, (2) the text of messages that you send to other users of the Service, (3) any user or screen name that you select in connection with the Service, (4) as well as any comments or feedback regarding the Service that you send to the bank.

Terms of Use

  1. Please review these SMS Terms and Conditions carefully and contact the bank (“we,” “us,” “our,” or “CB”) prior to enrolling if you have any questions or do not understand these SMS Terms and Conditions. By enrolling in our SMS program (“Text Messaging”), you agree to these SMS Terms and Conditions, and you also agree to CB’s SMS Privacy Policy.
  2. To opt out of Text Messaging, simply reply to CB’s text message on your mobile device with the word STOP.
  3. Each time you use Text Messaging, you affirm your agreement to our SMS Terms and Conditions and to our SMS Privacy Policy. We reserve the right to, and from time to time may, revise these SMS Terms and Conditions and/or its SMS Privacy Policy.
  4. When you provide information to us, you agree to provide accurate, complete, and true information. You agree that we may collect information from you including (but not limited to) your phone number, carrier details, timing and content of messages, and any other information sent to us.
  5. The bank may use this information to contact you and to operate, develop and improve our Text Messaging services. You may also receive text messages when you apply for, or attempt to use, a CB product or service, as applicable, or when you contact us. The bank message frequency to you may vary, but if at any time you determine the frequency of text messages to be excessive, you may immediately opt out of the Text Messaging service. The bank reserves the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property.
  6. Your wireless carrier and other service providers may also collect data from your Text Messaging usage, and their practices are governed by their own policies.
  7. By using Text Messaging, you represent that you are the owner or authorized user or subscriber of the phone number and wireless device that you are using to receive text messages from or on behalf of the bank.
  8. WE WILL NEVER SEND YOU A TEXT MESSAGE ASKING YOU TO PROVIDE OR CONFIRM PERSONAL DETAILS OR CONFIDENTIAL INFORMATION, SUCH AS PASSWORDS, SOCIAL SECURITY NUMBERS, OR ACCOUNT NUMBERS. DO NOT REPLY TO ANY MESSAGE REQUESTING PERSONAL DETAILS OR CONFIDENTIAL INFORMATION. Please, immediately report any such message by contacting us at 800-687-2265.
  9. Message and data rates may apply. Text Messaging is subject to applicable messaging and data fees from your wireless carrier. Please refer to your wireless plan details for more information. However, the bank does not charge you a separate fee for your use of its Text Messaging service.
  10. You acknowledge and agree that your receipt of any Text Messaging may be delayed or prevented by factor(s) affecting your wireless service provider, internet service provider(s) and other factors outside of our control. Text Messaging is subject to many factors including availability of service with your network, compatibility of your network and device with our systems, and processing by your mobile device. Text Messaging services are provided on an “AS IS, AS AVAILABLE” basis. The bank will not be liable for any delays or failures in your receipt of any Text Messaging. In no event shall we be liable for any claim arising from delayed, misdirected, or failed delivery of any information sent through the Text Messaging service.
  11. We may suspend or terminate Text Messaging to you if the bank has reason to believe you are in breach of current SMS Terms and Conditions. Text Messaging services are also subject to termination in the event your wireless service terminates or lapses, or in the event of your bank account closure or legal process. We may also discontinue Text Messaging at any time, in its discretion, with no liability.
  12. Text Messaging services are provided only in the United States.
  13. You agree to indemnify, defend, and hold the bank harmless from any third-party claims, liability, damages, or costs arising from (1) your use of the Text Messaging service, and (2) the provision of a phone number that is not your own.
  14. You agree to notify us immediately of any changes to your mobile device. In case of unauthorized access to your mobile device or service, you agree to cancel enrollment associated with the device immediately.

Opt-In

When you provide a phone number to us, you are authorized to provide this phone number and send or respond with “ACCEPT”, you agree to receive calls and text messages from City Bank at this number(s) for all your current and future City Bank products and services. Message and data rates may apply. Message frequency varies. Automated systems, including prerecorded or artificial voice may be used. To help protect your account security, City Bank does not support SMS or MMS functionality for recognized VoIP, prepaid, or landline phone numbers. In order to receive text messages from City Bank, such as servicing, collection, and one-time passcodes or suspicious activity alerts, an eligible phone number and Mobile Device are required.

Opt-Out

City Bank’s service provider gives you the ability to opt out of the Service for any reason. You can opt out by texting “STOP”.  After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. We reserve the right to send you certain communications relating to the Service, such as announcements and administrative messages, without offering you the opportunity to opt-out of receiving them.

Children

The Service is not intended for children under 13, and City Bank does not knowingly collect information from children under the age of 13. Children aged 13 or older should not submit any Personal Information without the permission of their parents or guardians. By using the Service, you are representing that you are at least 18, or that you are at least 13 years old and have your parents’ permission to use the service.
